§ 270-126. Restrictions.

The following restrictions shall apply to all land within the Floodway Channel District:

A. 

Building prohibited. The erection, use or occupancy of any structure or building within the F-1 District is prohibited.

B. 

Obstruction. The obstruction of any stream or streambed is prohibited except as may be authorized by special use permit under Article XIX of this chapter and by permit under New York Environmental Conservation Law.

C. 

Dumping. The dumping or draining of any waste, septage, solid waste, hazardous material, earth, ashes, rubbish, tree trunks, stumps, rubble, concrete, masonry, garbage, refuse or other trash is prohibited.

D. 

Modification. No stream channel in an F-1 District shall be channeled through any underground pipe or culvert except where approved in writing by the Rotterdam Town Engineer and subject to conditions and restrictions as may be necessary. Every such pipe or culvert shall be sized, designed, installed and maintained in accordance with standard water resource engineering practices acceptable to the Town Engineer.
